Six New York teenagers filed a lawsuit today against Donald Rumsfeld in the Manhattan Federal Court alleging the U.S. Department of Defense broke the law by keeping an extensive database on potential recruits.

Military recruiters have experienced difficulty meeting their targets because current members of the military keep dying and having parts blown off for an unjustified cause in Iraq. This is not a good recruitment tool, despite the fact that after they die the military will pay for their education. Turns out teenagers are not as dumb as everyone thought.

Responding to the lawsuit, the Pentagon insists it has done nothing wrong.

The Pentagon last year acknowledged it had created a database of 12 million Americans, full of personal data such as grades and Social Security numbers, to help find potential military recruits.

The Pentagon has defended the practice as critical to the success of the all-volunteer U.S. military, and said it was sensitive to privacy concerns.

In addition to keeping records on race, ethnicity, gender, and social security numbers, the Pentagon allegedly collected data on people as young as sixteen and held that data for more than three years. The current law does not allow for these records to be stored.

The students want the court to declare the database illegal, force the military to stop keeping improper records and pay for their lawyers.

I'm for just about anything to help get recruiters of the backs of students.

I've had no less than 3 seperate recruiters blatantly lie directly to my face, and it made me think; what happend when they lied to other people who didn't see through the lie?

Though it would've perhaps been more effective if the anti-military bias (not that I don't share it) was presented less venemously, I'm with anyone who thinks this has a good point. The idea of the military keeping tabs on all potential recruits is mildly disturbing at best, and if it is, as the arrangers of the suit allege, actually illegal... well, what more argument do you want?

i have absolutely no idea what the hell the title of this article has to do with anything, but military recruiters are like homeless people: dont make eye contact and they might not bother you. if they do bother you, ignore. if they touch you, shoo them away. if they threaten you, give them a fucking quarter.

I can't complain too much. Last time I was bothered by military recruiters, they stopped on the side of the road I was walking down and gave me a ride home as they talked to me. It was great because it was really hot that day and I was running late.

It has about as much to do with the thread as the title does.

Listen to hannity tommorow, or limbaugh and you will see the correlation between the title and the subject matter. I thought it was rather witty.

Hey I know... lets all ban armies. They are evil. While we're at it, lets do away with war. I'm sure if we ask nicely, opposing nations will lay down their arms.

Honestly, the point of the lawsuit is well enough. If the writer of the article was confident that the suit spoke for itself, the spin written here wouldn't be necessary.

The newswire has never been unbiased. It is not meant to be. That has been made quite clear many times.

Nobody said the newswire was supposed to be unbiased. It's the constant barrage of bitter, angry anti-government threads with "zinger" titles that attempt to lead the reader to believe there's more to the story than printed, the body text of which literally drip with sarcasm at any suggestion that the accused wrongdoer may be without fault.

I have to wonder if it any different than the info private companies already keep on us. If the law doesn't allow the military to do so then they need to comply with the law until changed, but what's so bad about the info recruiters are keeping?

The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) is a Federal law that protects the privacy of student education records. The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education.

With regard to disclosure of student information is says the following:


Generally, schools must have written permission from the parent or eligible student in order to release any information from a student's education record. However, FERPA allows schools to disclose those records, without consent, to the following parties or under the following conditions (34 CFR § 99.31):

School officials with legitimate educational interest;

Other schools to which a student is transferring;

Specified officials for audit or evaluation purposes;

Appropriate parties in connection with financial aid to a student;

Organizations conducting certain studies for or on behalf of the school;

Accrediting organizations;

To comply with a judicial order or lawfully issued subpoena;

Appropriate officials in cases of health and safety emergencies; and

State and local authorities, within a juvenile justice system, pursuant to specific State law.

Schools may disclose, without consent, "directory" information such as a student's name, address, telephone number, date and place of birth, honors and awards, and dates of attendance. However, schools must tell parents and eligible students about directory information and allow parents and eligible students a reasonable amount of time to request that the school not disclose directory information about them. Schools must notify parents and eligible students annually of their rights under FERPA. The actual means of notification (special letter, inclusion in a PTA bulletin, student handbook, or newspaper article) is left to the discretion of each school.



I am not seeing the Pentagon on this list.

That, NickFaust, is a question that should be answered after the trial is over.
Streamlining the recruitment process isn't a good enough reason for your Government to sidestep it's own rules. Sure it may be more efficient but that's not the point of a volunteer armed forces. Let those who wish to sign up do so own their own. Not be targeted by marketing.

Awesome post. The military is a necessity. "If you want peace, prepare for war" is a true statement.

First, he's not the worst leader ever. If you'd educate yourself, you'd understand that almost EVERYONE in the world thought Iraq had wmd's. Either way we removed an atrocious dictator and to me that's worth it. Those peoples lives are better because of what we did.

Second, if you knew anything at all about the government you would know that there are a lot of things they cannot tell the American public. They might have a reason for being there that you don't know about and might not for another 40 years. Deal with it and stop blaming Bush for everything wrong in this country. There was plenty wrong before Bush and there will be plenty wrong after.
