No, I'm with Fountain Lady. Not that she was a dumbass for falling into a fountain while texting, but those security cameras are suppose to be for security and public safety. There was no reason to upload that video to YouTube other than for the amusement of the mall personnel who monitor those cameras.

I get what you're saying, but at the same time she wasn't hurt, walked away before anyone could get to help her, and you can't even see her face to identify her. I'm pretty sure if she didn't come forward about this, not a single soul on the planet would know who she was.

who defines what the cameras are supposed to be for? The owners of the private property that she was on, that's who. I have never seen a mall with agreements spelling out how the footage will be used, only that you are being videotaped and if you don't like it, turn around now.

Well, I guess I should have RTFA before hand because I guess she is suing that mall because the security guards didn't check on her, not because they uploaded the video to YouTube. I still think that it is fucked up they uploaded it to YouTube.

It depends on how the law is written, but as is, I don't think she's got a legal leg to stand on. Ordinarily, I would say that this is a simple slip-and-fall negligence suit with intentional infliction of emotional distress tacked on. But payments for negligence are, at least in theory, supposed to remedy physical harm or injury to repair the fault created by another's carelessness; while she didn't deny that had any injuries, her video here certainly didn't affirm it or mention it in any detail. In practice, IIED is never awarded as an individual tort; it only adds to the amount of money awarded once they determine that you were physically harmed.

My guess is that this is a gambit to play hardball with the mall over a settlement. While both sides know this case won't survive at trial, if they drag the reputation of the mall through the mud, that could be just as, if not more, costly than the settlement award. The problem here, however, is that no one is going to be particularly sympathetic to someone who slips and falls because they were too busy texting to notice a pool in front of them.

As best I can tell, it actually was illegal for the video to have been uploaded to YouTube, since it's fairly clear that the only reason it was uploaded was so that everyone could laugh at Fountain Girl's expense. PA surveillance laws are hardcore like that.

That said, I don't blame whoever uploaded it and, aside from the part where it's illegal, I don't think they did anything particularly wrong--at least, not any more wrong than any other uploaded video featuring someone screwing up in a way that makes people laugh. Anybody with a phone manufactured in the last eight years could have uploaded the same video, possibly in higher quality and with sound (which would have made uploading it in PA super double illegal).

It is becoming more and more ridiculous to expect to be free from surveillance in any publicly-accessible space. Cameras are simply too numerous to expect otherwise.

Now she's the dumbass who fell in a fountain and then went on Good Morning America to tell the world exactly how stupid she is by not only falling into a fountain, but then threatening to sue about it.
