Yes. Fitzgerald had to make the indictment earlier than he wanted in order to avoid having to undo a tainted Blagojevich senate appointment. This meant his case wasn't as solid as it would have been had things been allowed to proceed to their conclusion. The longer this drags on, the more damage is done. That's why the pressure for Blagojevich to resign immediately is so high and why Fitzgerald will likely offer Blagojevich some kind of a deal to plead guilty quickly for a lesser sentence and avoid a prolonged and embarrassing trial.

Whether Blagojevich's massive ego will allow him to take such a deal remains in doubt.

You know what, the man fought the law and the law lost. At least for this second. The big Blo' will probably wind up with some serious fines and some sort of sixteen to eighteen month sentence, but for the short term, he basically stood up and said "Until a trial by a jury of my peers, I'm the legally elected governor and I've got a job to do." So he did, and Harry Reid and the transition team wasn't smart enough to see the play.

He might dirty as fuck, but the man seems to be a canny political operator and he played Senate Democrats for everything they're worth and got his appointee into the Senate. Frankly, at this point, it wouldn't surprise me if this man could stay out of jail easy, and somehow make an eventual political resurrection.

The guy stood up to his own state legislature and the U.S. Senate and said 'until you get me into a court, I'm the governor, deal with it'. He's clearly not as smart as all those professional political criminals who don't go to jail, but when backed into a corner he played the system and made virtually the entire Democratic Party look like idiots. Yeah, I'd call that canny.

Tonight Roland Burris is a U.S. Senator, as is Harry Reid. But only one of them looks like a complete jackass without any spine.

They're not mutuality exclusive, anyone can be defiant and egotistical , but to be defiant and make your opponents look bad while working within the system is canny.

Kwame Kilpatrick comes to mind as someone egotistical and defiant who didn't manage to play the odds well enough to at least win a few rounds in a few news cycles.
