I often see and hear people claiming that our Democracy means "majority rule" and extend this to mean that whatever the majority favors, whatever is "the will of the people," should be the rule of law. In principle, this is patently wrong! Yes, our Representatives are Democratically elected, and yes those representatives will try to pass legislation that favors the majority, but our country was NOT founded on the principle of majority rule -- it is NOT about what the majority wants, but quite the contrary, you fucking COMMUNIST! The point of the constitution is to protect the individual FROM the majority! It is about me and you having the right to do anything we want, even if every other person in this country despises it, so long as we don't infringe on anyone else's right to do what they want. Again, it is about being able to do anything and everything you desire and nobody being able to ever tell you that you can or cannot do something, so long as what you want does not impede or interfere with what anyone else wants. Get it? Of course, that is where the problems (and lawsuits) arise, determining where your rights start impeding upon mine. But, anyhow, do you see the critical difference in principle? It's all about protecting the rights of the individual and has nothing to do with what the majority wants.
I fear we've really lost sight of this when I see things like Prop 8 (California Amendment to ban gay marriage). I keep hearing them say that the courts, when ruling it unconstitutional to prevent gay marriage, ignored "the will of the people" as if that is somehow bad?!!!! That is their JOB -- to uphold the constitution and protect the rights of the minority, in the face of popular opinion. They are the check and the balance to the legislative branch, preventing the majority from crushing the minority.
Trying to change the constitution to remove minority rights is such a ridiculous affront to this country and what it stands for, it makes me sick. Anyone telling you they support prop 8 because it is "the will of the majority" is spitting in the face of our founding fathers and should get the fuck out of this country if they hate it so much. (Ok, that last part was just cause I wanted to be on the delivery end of that statement for once -- it's really just something stupid people say when they have no cogent argument).
