So we had this roommate, Joe. And he's psychotic. He got evicted on the grounds of disturbing the peace and harrassment. At first he was all about taking us to court, saying the eviction was illegal based on the fact that the evictors were not the landlords. But he never signed a lease entering into an agreement to follow the terms of the lease with the landlord. Instead, he signed an addendum to the lease created by Minda and Gwynne, the two roommates who ARE on the lease. As all his rent money went through Minda to the landlord, it seems to me to be obvious that he was subletting through Minda and Gwynne and not leasing through the landlord. Apparently he disagrees. Anyway, after losing his job due to a blemish (this is sarcasm, the charge was two counts of felony abduction, which, I'd like to add, he failed to mention on his rental application) on his record, he decided it was fate that he move in with his new girlfriend and proceeded to vacate the premesis.
Now, though he started sleeping at his new place on September 24th, his property was not fully cleared out from his room until the 29th. His property has not actually been cleared out from the premesis, as there is a huge pile of junk in our garage as well as other goods in the kitchen and basement. Once we found a new roommate to take over his end of the agreement, we decided to give back his security deposit, although normally when someone is evicted, their deposit is not returned and is used towards rent, etc. However, he's demanding back $220 of the original $240. The $20 is towards an unpaid cable bill from August. We then took out $56 for unpaid utility bills from September. He argues that since he was evicted, he is not required to pay those bills. Our rebuttal is that eviction is not a "get out of paying bills free" card. As long as you are living on the property, you are obligated to pay for the things that you are using. I would even be willing to cover the five days during which he was not living in his room, excepting for the fact that his junk was still in his room, thereby making the room uninhabitable for a potential roommate.
Then today we did an inspection of his room and other areas, such as kitchen drawers and shelves that he was using. In our house, we assigned particular shelves to each roommate to prevent "borrowing" food and such. Well, on inspection of his shelf, we discovered a rotting bag of potatoes with writhing maggots. This rotting mess destroyed the shelf itself as well as food belonging to other members of the household since the juice from the maggots devouring the potatoes had dripped down the shelves. Eric is taking the shelf in to Lowe's tomorrow to ask how much it would cost to replace the shelf.
Seeing as how Joe is being a dick over his unpaid bills, we've decided we're going after him for all he's worth. He is filing tomorrow to take Minda to court as she is the member of the house on the lease that still lives on the property. The story gets into even more detail but, for the record, he has sexually harrassed every female in the house, barracaded Minda into her room, stolen property from almost all of the roommates and (as you'll recall) lied on his rental application. Are we wrong for evicting him and giving him back money he doesn't even deserve back? I don't think so.
Anyway, this whole subbing thing is being difficult. They called me yesterday, but that's it for this week. And yesterday I had gone to bed at 4:00am because I assumed they weren't calling me. Argh. But I have already been called to do 8th grade science tomorrow. Woohoo.
I went shopping with Minda the other day and bought way too much. So I'm returning a couple of things. Except the Playstation 2 I bought. And Champions of Norrath. It has become my life. Eric and I are so completely obsessed. We played for about 10 hours yesterday, with a few smoke breaks, and about an hour or so of playing Big Mutha Truckers. Hah. So...I'm off. To defeat orcs.
