Another day, and again essentially nothing accomplished. This time I had a plan - I was supposed to be doing a behavior experiment on my mutant mice all afternoon. I went down to the behavioral facility, and of course, the activity monitoring equipment was no longer working. Dammit. Which is why I had so many damned posts in CE today, because there was really nothing better to do. Hopefully tomorrow will be more productive.

I had a good date tonight though. I went out with this girl K., who is super cute, short, blonde hair / blue eyes, smart as a whip, likes to joke around and is almost as big of a dork as I am (she's read the lord of the rings more times than me.) We had dinner at this place called Hell's Kitchen, it's nouvelle Mexican cuisine in, appropriately enough, the Hell's Kitchen neighborhood in Manhattan. THe place rocks, and we both liked our dinners.

Afterwards we braved the freezing cold and went to a horrendous bar to get more drinks. Which was fine, it just gave us more things to make fun of (the guy avidly watching the basketball game with his baseball cap turned backwards was the primary recipient of our derision.) We drank a few more beers, chatted each other up and then it was time to leave.

She's super-cool, and I like her a lot. But in my typical first-date dork mode, I didn't kiss her or anything after the date. I can justify this to myself by saying that a crappy kiss on 9th avenue in the freezing cold won't be as good as a real kiss somewhere nice on our second date. But really, I'm just a big wimp. Have no illusions.

In typical legionnaire fashion, I've found that when I'm totally smitten on a first date, I like her way more than she likes me. We'll see if this follows suit, but I've probably been on enough of these to have a good feel for it by now. More on this particular girl later - she has a friend coming in this weekend but we have tentative plans to go out next week. I'll take a confirmation of plans as a positive sign.

In other girl-related news, I finally heard from V. today. (just so you all know, I'm not dating Kafka characters who refer to themselves as individual initials, I just feel like I should at least make an attempt at preserving people's anonymity when they don't know I'm talking about them, except for the dork guy in my pictures) Apparently she got a job and then got sick and has been really busy since then, but wants to get together again soon.

And just to make things even more confusing, I'm going on another date with another K. (which stands for the same thing) who is also from Vermont (like the K. from tonight) later on this week.

It never rains but it pours.

I also got two good ideas for non-fiction pieces that will be coming very soon, maybe tomorrow. So delay that issue of the New Yorker to the presses, I'm sure they'll want to incude them.

Can you tell I'm drunk? I can.

I'm now going to watch the rest of "Big Trouble in Little China." Good night all.

In a nutshell, they are renegotiaing the terms of the contract, you can accept or not. Sometimes what they do is legitimate, sometimes its questionable, but they pretty much bank on the notion that so long as their plocies aren't so out of line and universal that it would trigger a class action lawsuit nobody is going go to the trouble of suing them. ISPs are worse. They make unilateral decisions all the time that are illegitimate, but as the only recourse you really have is to sue of a refund of that months payment, they usually get away with it. in either case your continued use of the service is considered ratification of the new terms. There was no such trigger event to inicate acceptance of your offer so they have declined to accept your new terms.

The military OTOH is quite different, because you cant get out of the "contract". They say "Yeah it was a two year enlistment, but now its four." With any other part, you can simply say "Nah, fuck off, you breached the agreement her's your uniform back." Not so with military contracts. Military contracts youre bound to perform regardelss of how they change the terms (for the most part, there are constitutional and federal law limitations)
