Man With Faulty Penile Implant Gets $400K

PROVIDENCE, R.I. (AP) A former handyman has won more than $400,000 in a lawsuit over a penile implant that gave him a 10-year erection.
Charles "Chick" Lennon, 68, received the steel and plastic implant in 1996, about two years before Viagra went on the market. The Dura-II is designed to allow impotent men to position the penis upward for sex, then lower it.
But Lennon could not position his penis downward. He said he could no longer hug people, ride a bike, swim or wear bathing trunks because of the pain and embarrassment. He has become a recluse and is uncomfortable being around his grandchildren, his lawyer said.
In 2004, a jury awarded him $750,000. A judge called that excessive and reduced it to $400,000. On Friday, the Rhode Island Supreme Court affirmed that award in a ruling that turned on a procedural matter.
"I don't know any man who for any amount of money would want to trade and take my client's life," said Jules D'Allessandro, Lennon's attorney. "He's not a whole person."
A lawyer representing both Dura-II manufacturer Dacomed Corp. and the company's insurer declined to comment. Dacomed maintained that nothing was wrong with the implant. It filed for bankruptcy after the lawsuit was filed.
Lennon cannot get the implant removed because of health problems, including open-heart surgery, his lawyer said. Impotence drugs could not help Lennon even if he were able to have the device taken out, because tissue had be to removed for it to be implanted.
Woman Accused of Attack With Dead Puppy

ST. LOUIS (AP) A woman accused of pummeling a dog breeder over the head with a dead Chihuahua has been charged with two misdemeanors and reimbursed the money she paid for the puppy.
Lisa Lynn Hopfer, 33, of Wentzville, was charged with trespassing and third-degree assault in the June 7 incident, authorities said.
No listed phone number for Hopfer was available. A man at her home who declined to identify himself told the St. Louis Post-Dispatch Friday that "there's another side to the story," but declined to elaborate.
Hopfer told police she had taken the puppy to a veterinarian, who said it was only 4 weeks old and needed to be returned to its mother. But before she could return the puppy named Chloe, it died.
Authorities said Hopfer went to the breeder's home, pushed her way inside and began fighting with the breeder as she tried to make her way to the basement to get another puppy, police said.
Linda Hulsey, 33, of St. Peters, wrestled the woman out of her house to the front porch, where the woman then hit the breeder over the head numerous times with the dead puppy, police said.
Hulsey said she was hit with the dead puppy at least 30 times and went to a hospital for her bruises, but had no serious injuries. She said she was upset that Hopfer had accused her of selling the puppy too young and said the puppy was two days shy of 6 weeks old.
Hulsey said she later returned the $100 that Hopfer had paid for the dog.
Farmer Agrees Not to Open Hitler Memorial

MADISON, Wis. (AP) A retired farmer who claims he was a Nazi SS officer has agreed not to open a memorial to Adolf Hitler he built in southeastern Wisconsin, county officials said Thursday.
Ted Junker, 87, had planned a June 25 grand opening for the shrine on his farm near Millard, about 50 miles southeast of Madison. Word of the opening generated waves of outrage.
Walworth County officials met with Junker on Thursday morning and persuaded him to keep the shrine closed, said Mike Cotter, county deputy corporation counsel. No one answered the phone at Junker's farm when The Associated Press called Thursday.
Cotter said Junker would need permits to operate what amounts to an assembly hall or museum. Junker showed no interest in getting those permits, he added.
Cotter said he also warned Junker the shrine could provoke retaliation, and that his farm, which has parking for less than 10 vehicles, couldn't handle the hundreds of visitors the shrine would draw.
"He understood that this had blossomed into something he was never expecting," Cotter said. "When he saw us today, he made the comment again about how famous he'd become. You could hear the phone ringing constantly. Constantly."
Cotter said he planned to have Junker sign a legal document ensuring he won't change his mind and open the shrine anyway. Sheriff David Graves said deputies still would step up patrols in the area June 25 to stop any trespassers.
Junker told the Milwaukee Journal Sentinel he volunteered to join the German Waffen-SS, Hitler's feared special police, in 1940 and served in Russia. He came to the United States in 1955 and worked as a janitor in Chicago. He bought 120 acres in Walworth County 43 years ago to farm.
He set up the shrine to correct what he called inaccuracies about the war and Hitler's role in it. He told the newspaper he doesn't believe Hitler was to blame for starting the global conflict, in which 50 million people died, including some 6 million Jews in the Holocaust.
Patrick Broderick, a 20-year-old factory worker from Genoa City, was soliciting people online to protest the shrine's opening. On Thursday he said he will drop his plans as long as Junker doesn't try to get the permits he would need.
"He has the ability to speak his mind. But I think he's wrong and morally we have to take a stand against it," Broderick said.
Cotter said Junker built the shrine into the side of a hill on his property and painted tributes to Hitler on the walls. Inside are a Nazi flag and two pictures of Hitler, and the top of the building features a granite wall honoring Germans killed in World War II, he said.
Cotter said the display also includes the First Amendment, which guarantees the right to free speech.

ANN ARBOR, Mich. (AP) A marriage-minded man ran naked through his neighborhood, trying to show his hesitant girlfriend that taking risks is important. He got more than he bargained for when he ended up being chased and shot at.
"Just when you thought you had heard everything," Ann Arbor police Detective Sgt. Jim Stephenson told The Ann Arbor News.
The couple were discussing marriage early Wednesday when the woman said she wasn't sure if she was ready, according to Ann Arbor police reports. The man responded that taking risks is an important part of life and, to prove his point, jumped out of a first-floor window and ran naked across the street.
Before he could return, he spotted a couple walking and hid in some bushes to avoid them. A 28-year-old man noticed the bushes rustling and bare feet underneath, then drew a .40-caliber handgun and ordered the naked man out, police said.
The naked suitor ran away, but the armed man gave chase and threatened to shoot, police said. The gunman fired a shot and the naked man fell to the ground, suffering minor injuries.
A resident called police, who arrested the gunman on charges of aggravated assault and carrying a concealed weapon. He was taken to the Washtenaw County jail but released following further investigation, police Sgt. Patrick Hughes told The Associated Press.
The naked man was not arrested and didn't want to pursue charges, Hughes said.
