Awoke on my couch at 9:00 PM, criminal law book on my chest, having fallen asleep an hour before reading about a rape case involving a girl who claims that her 17 year old boyfriend held a knife to her OTHER boyfriend's neck and forced them to have sexual intercourse...everybody involved thought she was 18 until the father walked into the trailer, and said, "What are you doing to my 13 year old daughter!"
Ah, California. I'm going to make it there, someday...
You would think that rape is an easy crime to define, and that the line is absolute. Turns out, the line is blurry. Most cases are, of course, cut and dry, but some are quite gray. I never would have thought it. I can promise you, though, none of them are cases where somebody says 'she was asking for it.'
