Not everyone here might be familiar with the recently signed bill the Canadian government just signed into law. I figure it'd be good to give the backstory before I explain what C36 actually is.
At the beginning of 2014, the Supreme Court of Canada struck down our three major laws around sex work. Those three laws were living off the avails of prostitution, solicitation, and working in a common bawdy house. Basically, sex workers couldn't hire support staff, communicate with clients, or work together indoors. These laws were struck down for violation our Charter of Rights and Freedoms, specifically around safety and security of the person. The Supreme Court gave the federal government one year to write new laws if it chose before the old laws expired.
Thus C36 was created. The bill is rather confusing, but the main laws it presents are benefiting materially from prostitution, purchasing sexual services, communicating in any way, posting advertisements on behalf of a sex worker (we can advertise on our own, but newspapers, agencies, etc. would break the law by hosting them), selling sex near schools or playgrounds, and makes any kind of bondage or possession of bondage implements into assault or weapons charges.
Basically, the new law, passed by a Conservative majority but unsupported by any other Members of Parliament, is a clear violation of the Charter of Rights and Freedoms based on the recent Court decision. Sex workers all over the country are opposed to this new law. Many of the arguments presented in the House and Senate in favour of the bill painted sex workers as naive victims, ignoring the many of us saying that labour laws and rights would help us with the exploitation that does exist in the industry, and that for many of us it's a job we've chosen and would like to keep.
I, myself, have done sex work, and I vehemently oppose this new law. I believe that the men (and women!) who pay me are decent and lovely people, not criminals. People like sex, and in a capitalist society, people are willing to pay for things they really like and others are willing to sell. Whether I'm selling my time or a set of sexy pictures, I love having a job that brings smiles to faces and wet spots to underwear! :D
