1) Who has some good Ska bands I should be listening to? That shit makes me so happy, I must go find more of it to download!
2) Has anyone seen the cover of this month's National Geographic? It's freakin' me out!
3) Here's an interesting event from this week.....
I was threatened to leave a vendor's office. Anyone with leagl insight, please give me the right 411 here:
a) This vendor sends out mass-emails, etc
b) This vendor & I have a contract - I pre-paid him $12k, he deivers me sales of products, and his bounty it taken out of that pre-pay.
b1) The contract has no end-date for sales by a certain time, and the contract is explicitly for payment of services to be delivered.
b2) So far I still have a credit of about $11,300, because vendor made some sales, but then stopped trying.
c) This vendor refuses to return calls, schedule meetings to discuss this problem/contract/account balance, etc..
d) One of my former employees is now his employee, and I am supposed to have lunch with her today - I visit vendor's office 2 days ago to confirm this with her.
e) While there, I spoke to my former employee - not about her current work, not about my missing $$, not about the owner of the vendor company, only about her social life & confirming our lunch.
f) Vendor then threatens to call 911 if I dont leave his office. I calmly asked why, 3 times. He flips out & yells "get off my property, you're in our offices". I calmly leave.
Now, if I'm not mistaken, legally, I'm still a client (he has my $$ & has not fulfilled his contracted obligation), so
a) I'm not tresspassing
b) I'm not soliciting
c) I'm not a vagrant
d) I'm not loitering
And really, I'm debating about showing up there, letting him freak out, call the cops, and if they show up, explain that the vendor is in fact schemeing to defraud me (I'm sure there's a better legal president for this though).
Also note:
a) the Vendor has heen sued numerous times for 'stealing' peoples $$, which was do to 'non-service' of contracts.
b) the Vendor has also been sued for sexual harrasmet & assualt to former employee(s).
c) the Vendor is rumored to be divorced with 5 kids, but I cannot believe this to be true, he's too young.
So? Anyone with a legal mind and some ideas/answers?
My goal here is actually to have the contract fulfilled, I do not expect a return of funds (it's a non-cancellable contract).
