Not only are some people idiots but we reward them by allowing them to sue for stupid and frivolous reasons. Pick up any product and read the warning label. The particulars of the warning label are there because someone used the product in the manner described and was injured and successfully sued the manufacturer. That is why you should not throw a can of hair spray into a fire, or squirt charcoal lighter into a fire, or take a hammer to a pressurized fuel tank, or plug an electrical device into an outlet while taking a bath, or determine whether a gun is loaded by squeezing the trigger while looking down the barrel, or change a tire on your car while on an incline without blocking a wheel, or a million other scenarios. People always laugh when they read the warning labels and wonder why these stupid warnings are there. It is because of these idiots. I know of one lawsuit where a zoo with an outdoor seal water show is being sued by a woman because she fell while walking across the wet deck. She alleges that the zoo was negligent in allowing the water to accumulate on the deck. It was a water show with seals performing. They splash water out of the pool as part of the show. She knew or should have known that the water was on the deck but sued anyway because she fell. If you shovel snow from your drive and sidewalk and leave ice and snow you are at risk but if you do not shovel and someone falls you are not at risk because you did nothing. Whatever happened to common sense and responsibility? As a lawyer even I do not understand why there is so much litigation sometimes. I had one client who was sued by a person because he represented a song writer who composed a song about capturing dreams. The plaintiff was pro se and sued everyone in the world he could find as he thought his dreams were being captured. When I appeared on a massive consolidated motion to dismiss there must have been 50 other attorneys as well. We were all there to have the complaint dismissed as to our respective clients and at a conservative $150 an hour per attorney this pro se guy was tying up a lot of expensive legal talent. The sad thing was no one could seek redress from him as he had no money. Yet my client like many of the other defendants had to hire an attorney and spend resources to get this mess taken care of and this guy out of their lives. This guy had least had a mental disease or condition to explain his behavior. Unfortunately most of the other idiots are just out for themselves and their greed is so evident.
