Virginia Legislator: Criminalize Unreported Miscarriages

Virginia Republican Delegate John Cosgrove introduced House Bill 1677 which would require in part:

"[W]hen a fetal death occurs without medical attendance, it shall be the woman's responsibility to report the death to the proper law-enforcement agency within 12 hours of the delivery."


If the law passes, a Virginia woman who spends the day after her miscarriage at home crying is guilty of a misdemeanor punishable by up to a year in jail.

According to Democracy for America, which is tracking this story, the police report which must be filled out by all women who experience a "fetal death" would demand all sorts of intrusive information - education history, previous deliveries, and prenatal care history are only a few examples. This is more information than Virginia law currently requires be filed after an abortion.

...the legislative agenda of numerous anti-abortion groups includes increased reporting of fetal deaths and issuance of death certificates for miscarriages. The point is to advance the legal recognition of "personhood" for all "products of conception".

In the 2003 legislative session in Virginia, a law was passed allowing parents to request a “birth certificate” for a stillbirth, a law that is clearly in line with the agenda of anti-abortion extremists to recognize embryonic and fetal personhood. The fact that Virginia is one of the few states that requires reporting of deaths of all “products of conception” regardless of gestational age plays in to this anti-abortion agenda.

Yes, it's unconstitutional, but that takes time. I'd bet it'll pass before it's constitutionality is ruled upon.

And by the direction the Supreme Court is going, they may interpret the Constitution different than us folks.

Yeah, but we're talking about a red state here, so there's a really good chance that this will be enacted. And I'm guessing that after the Republicans 86 the filibuster in the Senate, we'll be having an influx of judges whose sense of smell isn't quite as acute as yours. frown mad

This is just another way to intimidate women from having an abortion. I’m surprised there isn’t some sort of add on about having to post the reports for the public. Which would be a wet dream for any pro-life extremist to hassle the women.

This is just a sad misleading bill.
