Bush and McCain Put Their Raping Hats On

The new torture bill being peddled by the White House and the Senate includes loopholes that allow for rape, sexual assault and sexual abuse. Serbia would be so proud of us. In it’s current form, the bill could make it impossible to prosecute rape or sexual assault as torture. In order to prosecute torture, according to the legislation, there must be specific proof of intent to commit a crime. Motive is nearly impossible to prove in cases of rape or assault according to Rhonda Copelon, a professor of law at the City University of New York.

The bill only mentions rape or sexual assault twice and both times the wording creates loopholes to allow American torturers to engage in the heinous acts. The bill blatantly does not define rape as sex without consent, which is how federal law defines it. Without fear of prosecution guards or interrogators could easily rape inmates as the bill is currently written.


Experts on sexual violence fear that the intent is to absolve American soldiers and their commanders from prosecution for deeds that have occurred since Sept. 11. Copelon also points out that the United States has been trying for years to write a specific intent requirement into international law on torture.


The bill’s definition of sexual abuse is also very narrow, requiring physical contact. These means prisoners could be ordered to strip, and forced into a pile of other naked prisoners (Abu Ghraib) or wear underwear on their head while someone takes nice photos.

Neither Sen. Lindsey Graham nor Sen. John McCain, the bill's authors, responded to questions from the New York Times about why they are okay with rape.

I wonder if Lindy England will get out of the brig if this bill passes? I also wonder why we don't just withdraw from the Geneva Conventions since our dear leader finds complying with it so odious?

oh hell yes! if this bill is as mister fearthereaper states it is passes i am so joining the military! just think of the possibilities; violating bodily orifices with foreign objects, constructing pyramids of naked prisoners, raping female prisoners and getting to document it all the while with a big smile on my face with no repercussion whatsoever! two thumbs up, way up (you know where!). finally a way to get laid without all the hassle of dinner and smooth talk...imagine a race of beings from outer space observing humanity, what would they think? unless they're war mongering rapist then we're fucked, possibly literally...aw man, maybe humanity does deserve to be wiped off the face of this planet or raped by war mongering rapist space aliens...y'know, whatever comes first.

I'm all for jumping down the throats of Bush, his administration, and the GOP at large. I do, however, feel the need to reserve judgement on Senator McCain's actions. In my examination of his political and voting records I may not agree with all of his decisions, but have NEVER seen him vote for a bill that is blatantly and indefensibly wrong. Even the war, as much as I disagree with it.

Agreed, McCain and Graham might have simply overlooked this aspect as odd as it sounds. They both seem to have the genuine interest of detainees as well as our own soldiers (in case of capture) at heart. I'd like to see if something is added after the intial criticism settles down.
