In a criminal case in Connecticut, Heather Specyalski was charged with manslaughter in connection with a car crash in which a man, Neil Esposito, was killed. She is arguing that she could not have been driving at the time, as the prosecutor claims, because she was performing oral sex on him at the time of the crash.
"A defendant has a right to offer a defense no matter how outlandish, silly or unbelievable one might think it will be," Superior Court Judge Robert L. Holzberg said. He added: "No one ever told me in law school that we'd be having these kinds of conversations in open court."
Hozberg also denied the defendants motion to use gender as a basis to eliminate jurors, as women jurors would be more likely to convict.
