Neighborly Act Results in $900 Fine

Two Colorado teenagers have been ordered to pay $900 in medical and court costs after a gift of cookies and paper hearts caused the recipient to experience anxiety and panic attacks.

Taylor Ostergaard, then 17, and Lindsey Jo Zellitte, 18, paid the judgment on Thursday after a small claims court ruling by La Plata County Court Judge Doug Walker, a court clerk said on Friday.

The girls baked cookies as a surprise for several of their rural Colorado neighbors on July 31 and dropped off small batches on their porches, accompanied by red or pink paper hearts and the message: "Have a great night."

The Denver Post newspaper reported on Friday that the girls had decided to stay home and bake the cookies rather than go to a dance where there might be cursing and drinking.


Forty-nine year old Wanita Renea Young, one of the neighbors who received the cookies, filed suit after being seen in the emergency room of a local hospital the next day. She claims that the gift, left on her doorstep at 10:30 p.m., had frightened her so badly that she thought she had experienced a heart attack.

The judge awarded Young her medical costs, but did not award punitive damages. He said he did not think the girls had acted maliciously but that 10:30 was fairly late at night for them to be out.

I think this is a bullshit piece of fake news. Absolutely. Something to get people pissed off about so-called "frivolous lawsuits." We know that the White House has absolutely no problem producing false news, paying so-called "reporters" to champion their causes. This is right up their alley. Those poor little girls wanted to bake some cookies instead of going to an evil (think Footloose) dance where there might be "cursing" and "drinking" god forbid. They were just being good christian neighbors when those damn greedy trial lawyers, heartless bastards that they are, and this cold-hearted, calculating granny (with a vaguely ethnic sounding name) decided to gang up on these young innocents and exploit their good deed. This is perfect to tug on the heart-strings of traditional values, middle-american that the Bush administration is trying to win support from on this issue. He's actually touring the country right now to whip up support for his awful policies using tear-jerking mythology like this to play on people so that he can later prey on them. Basically Bush wants to give back to his corporate donors by doing away with a consumer's ability to keep corporations in check by holding them responsible for their wrong-doing. A drug company lies to you about the side-effects and you suffer severe health damages? Fuck you, its a frivolous lawsuit! A chemical company dumps toxins into the water supply and kids start getting cancer? Fuck you, its a frivolous lawsuit! Unnacountable private tyrannies (otherwise known as Corporations) demand complete deregulation and complete freedom from consequences of their awful behavior. Bush is their little puppet mimicking their rhetoric and peddling their bills in congress. This is a piece of corporate trash journalism, its propaganda, it disgraces this website to put this up in the "news" section.

That is ridiculous. The 49 year old woman needs to chill out and not die from seeing a cookie. Once, I gave my new neighbors cookies I had just baked (as a bundle on the doorstep with a note on top, and rang the doorbell) and they LIKED it. What happened to the times of, oh, two years ago? Sure, 10:30 is kind of late, but jeez. The punishment was not deserved at all.

If she got $900, that probably means she was fine and only got charged for the emergency room. So she probably went to the hospital for no reason. I really hope, but I doubt, that they get a good lawyer and try and fight this.

Also, I just noticed the woman is 49 years old. The more I notice, the more ridiculous it is. I hope there aren't any thunder storms in Durango, Colorado, it will scare the woman to death.

So, I'm married to a law student and most of the lawyers I've met through her a really nice, decent people. There are a few that are scumsuckers but that's not really the point.

The point is that one of the judges that does small claims court calls it "open mike night at the courthouse". Anyway, in small claims people rarely have lawyers so this is just some judge somewhere with his/her head up thier butt. So, there's probably only one scumsucking lawyer involved and that's the one setting on the bench.
