Workplace Bullying Law: Holy Shit, When Does it End?

There are so many horrific reminders of the current state of society, and the rapidly plummeting situations around us, that it's hard for one new development to even stand out amid the craziness. So, so many, grim signposts to choose from. An idiotic ruling here, a stupid action there... In that context, what could possibly be so egregious as to snap you out of your malaise and cause you to react? Why the following piece of anti-bullying legislation:
An eye roll, a glare, a dismissive snort these are the tactics of the workplace bully. They dont sound like much, but thats why they are so insidious.
They don't sound like much, because they are not, in fact, much. These are also the tactics of most people, most of the time, during most of the activities on the planet.
How do you complain to human resources that your boss is picking on you?
Seems pretty straightforward to me...
Who cares that a co-worker wont return your phone calls?
I don't... He doesn't... Yes, I'm being glib but, this "problem" seems to be blown a bit out of proportion.
Bullying in the workplace is surprisingly common. In a survey released last fall, 37 percent of American workers said they had experienced bullying on the job, according to the research firm Zogby International.
Where's the survey on the percentage of people who are mean? And the one cataloguing all those people whose feeling were hurt?
Unlike the playground bully, who often resorts to physical threats, the work bully sets out on a course of constant but subtle harassment. It may start with a belittling comment at a staff meeting. Later it becomes gossip to co-workers and forgetting to invite someone to an important work event. If the bully is a supervisor, victims may be stripped of critical duties, then accused of not doing their job, says Gary Namie, founder of the Workplace Bullying Institute, an advocacy group based in Bellingham, Wash.
Oh my God, did you see him just belittle me? And then he gossiped about me! And now my duties have been stripped!!
Perhaps I should go to another superior, try to figure why I'm such a pussy, fight back, get another job, or come to the realization that the world is hard and unfair and there are far more important things to cry over, and maybe someone else is hiring world class sissies today?
Nah, I'll wait for someone to pass a law. After all, it's 2008 and one of those gets passed every seven minutes! In fact, every time an angel gets its wings, it's slapped with brand new, anti-flying legislation. Thanks government!
The New York State Legislature is considering an antibullying bill...
Sigh...
Business groups often argue that existing laws are adequate to protect workers. But bullying generally does not involve race, age or sex, which have protected status in the courts. Instead, most workplace hostility occurs just because someone doesnt like someone else.
Holy shit... Yes, not everyone is going to like you. Not everyone is going to be nice to you. Some people are dicks. And there's nothing the government needs to or should be doing about it. NOTHING.
I know that sounds callous and uncaring and, really, I don't care. But if I did, I'd be making the same point. Trust me on that. This is insanity.
Many of these situations fall between the cracks of existing state and federal employment law, said David C. Yamada, a professor at the Suffolk University Law School in Boston, who has drafted antibullying legislation. There is a real gap in the law that someone could be tormented and subjected to humiliation and really be suffering because of it, but the courts are saying its not severe enough for us to allow the lawsuit to go forward.
Someone could be tormented and humiliated even with a law like this in place, there is no reasonable effective way to police something like this and the courts already have far too much to worry about. Please, society, enough...
Some victims become physically ill from the stress, with depression, anxiety and even symptoms of post-traumatic stress disorder.
Yes, this is called "working." Go to the police with threats, go to your boss with problems. If he's too busy to bother, think about why that might be, and then think about whether a court of law should really be finding the time for it, if your dumpy boss can't. That's the system, I'm sorry, it kinda sucks, and if push comes to shove you might need to find a solution, (B-b-b-but, all by myself??), but a lawsuit ain't it.
Just to be on the safe side, for those of you who may feel I'm on the wrong side of this, let's take a look at some of the people affected
I just got home from working a twelve-hour day at the firm where I was yelled at and humiliated in front of the rest of the legal team. What an arrogant jerk. I was considering quitting, but after reading this story, the solution seems even more clear.
Ahh the solution. Which is, apparently, wait for this law to get passed and then... huh?
Because of political maneuvering my boss was let go and I was put under another manager. I had created a product that had saved the company over $30 million, yet the first thing my new boss said is that we dont have any stars in our organization.
Hotshot, maybe that's because you can't stop talking about the supposed 30 million dollars you saved them. And then wrote to a fucking newspaper about it.
I have been called faggot repeatedly, had someone walking around telling people he was going to give me a columbian necktie, walked back into my work area for forgotten keys and caught the same menatally unstable individual sabatoging a job I had left set up.
Um, PLEASE CALL THE POLICE IMMEDIATELY. Holy shit. I'm fairly certain behavior like this is prohibited under existing laws.
...same menatally unstable individual sabatoging a job I had left set up. I have been to personnel and he got suspended once because he actually put his hands on me and a second time because he smashed a time clock with his fist ..
You again? Jesus, sir, I'm begging you, stop typing and GO TO THE COPS.
Once, while I was working in my cubicle with my back to my computer, she came out of her office screaming, Didnt you read the email I just sent you?! She got away with this behavior because her boss was another incompetent political appointee.
Maybe she got away with it cause you actually never read her email? And I'm curious, what position were you hired for that involved you "sitting with your back to your computer." Were your feet up and eyes closed? Cause that job's called "shitty worker."
I had a boss who bullied me so badly that by the time I decided to file a harrassment complaint against her I had to wait another two months because the stress of her bullying created a pain in my spine that radiated up my back across my right shoulder and down into the wrist of my right arm preventing me from writing or typing.
Ahh, the telekenetic bully, a dangerous foe indeed. This was also the two months where you had laryngitis, I'm guessing? And all your friends and co-workers had gone on that cruise without you, thus preventing them from speaking up for you or writing a letter you dictated...
Finally a sensible response.
Anyone whos unduly bothered by an eye roll, a glare, a dismissive snort hasnt encountered real bullying.
Please, let this law fail. It seems that so many of these asinine laws pass that the reaction goes full circle, even among sensible people and inevitably some guy pipes up that "well, these laws make sense and people can be hurt etc..." That guy is wrong. This law is ridiculous. Please stop, everyone.
Make no mistake, TheCoolerKing hates bullies, and you should too.
