Straight White Guy Screwed by Homophobia



I can't help but find this story completely awesome.

Ron Garber knew his former wife was living with another woman — and had taken her last name — when he agreed to pay her $1,250 a month in alimony.

What he didn't know was that the two women had registered with the state as domestic partners under a law that was supposed to mirror marriage law, Garber said.

State marriage laws say that alimony ends when the former spouse remarries, and Garber reasons he should be off the hook, given that domestic partnership is akin to marriage. But an Orange County judge has decided that registered partnership is cohabitation, not marriage, and that Garber must pay.



I predict that a few more stories like this and the gays'll be getting marriage rights right quick.

Seriously, the guy sounds like a decent sort, and I'm pretty sure that he'll sort something out sooner or later. Big pain in the ass, of course. And the news story is quite good and, I think, clear about the broad range of legal nonsenses involved in "domestic partnership but not Real Marriage" legal complications. Just goes to show that discrimination sucks for everyone, even the people it's supposed to "protect."

Bitch_PhD is doubly amused that this is happening in Orange County, which as y'all may or may not know, is the most reactionary of wealthy SoCal reactionary Republicania.

Years ago I read a similar story where the ex-wife married a man. They didn't get 'state' married, just 'church' married so the ex-husband was still on the hook for alimony. He sued, and the judge ruled that the ex-wife and her new husband were in fact married and got the ex-husband out of alimony. I wondered at the time if the ex-wife had married a woman, would the judge have ruled the same way.

I know that, politically speaking, it might be a means to the ends of having gay marriage legally recognized, but I don't know if "awesome" is the right word, aside from that his ex-wife is taking some awesomely uncalled-for advantage of him, which is pretty sad...

also, she ought to be called out bigtime by the gay community. they're fighting for their rights (which i'm completely in favor of) and she's using loopholes in the law to take advantage of her ex-husband. regardless of her motivation for doing so, it's definitely got the potential to give the entire community a bad name in the media and, at the very least, it'll give the other side more ammunition in their obscene war on human rights.

Um, given that the article finds this awesome, I think the article sucks.
