Jill Coccaro, 27, was arrested on a topless stroll two years ago, despite a 1992 state appeals court ruling that concluded women should have the same right as men to take off their shirts.
Coccaro, who now goes by the name Phoenix Feeley, remained in custody for 12 hours before she was told prosecutors were not going to pursue charges.
Her attorney, Jeffrey Rothman, told the Daily News that his client won the civil rights settlement from the city, which did not admit or deny wrongdoing.
"We hope the police learn a lesson and respect the rights of women to go topless," Rothman said.

Caccaro, who must be the only person left in America without a blog, alleges that she was mistreated in the 12 hours she was detained. She said police dragged her out of the police car by their hair and put her through a psychological evaluation. But getting her kit off is nothing new to Ms. Caccaro/Feeley.

She told the newspaper she had gone bare-breasted after running the 2004 city marathon without police bothering her.
"I've always just felt that was something natural," Feeley said of going topless. "I've kind of always done it out of practicality."


While I’ve never really felt like practicality was an obvious reason for bare breasts, I’m in no position to argue. And neither is the city of New York, after the aforementioned case of People v. Santorelli. In that case, the Court of Appeals (New York’s highest court) found that the criminalization of mere exposure of specific parts of a woman’s breast could not sustain equal protection review. That’s a fancy lawyer way of saying that it is totally cool if you’re in NY and you’d like to get naked, like now. (Please)

I've read hundreds, if not thousands of poems, heard thousands of different songs, read more books than I care to think on, and I've yet to become desensitized to a well made turn of phrase. I see no reason to think it would be any different for boobs.

Toplessness in NY is actually pretty common, especially in the parks and beaches. My wife and I used to see the same topless woman when we would go to the beach every summer and she was easily in her eighties.

Of course there was always the beautiful Europeans splashing in the waves topless and playing volleyball.

No big deal really, and yet, total and absolute paradise. smile

There is no such thing as desensitization to sexual things. We like sex. Let us look at sex.

This is the first time I've heard of anyone getting in trouble since the spat in 1992.

I thought NY cops had more important things to deal with other than half naked hot women.

I've lived in Manhattan for 27 of my 31 years and I have never seen a topless woman in public here. The other four years were spent in Berkeley. That place is lousy with topless broads.
