Doctor to Pay Child Support for Shoddy Workmanship

You break it, you bought it.

A court ruled on Wednesday, that the gynecologist who botched a contraceptive implant operation is responsible to pay child support for a 3 year old boy. The mother, plaintiff, and former patient will receive 600 Euros (approx. $769) per month for up to 18 years.

The device installed in the woman was supposed to protect against pregnancy for 3 years, but within 6 months the malfunctioning device could no longer be found in the woman's body.

What the hell is it? A sperm guided laser? Dunno.

Well, newspapers are thrilled that doctors can now be held accountable for professional workmanship the same way as "a shoddy plumber," – gotta love the comparison, right? – but the newspaper was a little torn on the other implications...


While it should be welcomed that a doctor can now be held to account in the same way as a shoddy plumber, the newspaper said, how could a child whose parents had sought damages for its birth ever come to terms with the situation?


The German Newspaper Die Welt feels bad for the boy:


"In addition to the highly private inkling that he was not wanted by his parents, he now has official confirmation that he was born by mistake," Die Welt also said.


I hope the boy can take some consolation in the fact that most people are here by mistake. Children, people, many of you were mistakes. Get over it. Your mommies and daddies still love you. They might no longer love each other because of you, but they still love you, and that's what's important.

In addition to the child support owed, which includes 3 years of back pay the ruling concluded that the biological father should be compensated for the maintenance he was paying for the child.

I think I'm going to sue the doctor that delivered me, on grounds that I wish I had been aborted. That should be worth 50Gs easily.

lol poor kid...o well.its true tho alot of kids were mistakes...good or bad depending on the mood of the parent.

My mother said i wasn't an accident, I was a surprise. She was surprised she could still get pregnant at 38, and even more surprised my dad wouldn't fork out the 400 to get rid of me.

Why didnt they just have the doctor pay for the abortion if they didnt want the kid? Would have done all involved a favor.

A pharmacist was sued a few years ago, because he didn't catch that the medication a doctor has prescribed one woman would negate the effects of the birth control that she was on. He has to pay child support till the kid turns eighteen too.

I knew I was an acciedent, heck my mom even told me that she hadn't intended on having children, and then she gets pregnant with twins from a broken condom. I know my mom loves me and that she was glad she had me, and if my mom would have gotten child support from the condom company I would have thought that was awsome!

Maybe the doctor can now sue them for the amount he is being ordered to pay because they did not abort the child when she discovered she was pregnant or arrange for it to be adopted by someone who actually wanted a child.

A valid point, but ... the woman paid for this device intending to never become pregnant again. The shitty doctor and the shitty device did not deliver what they promised. They should be held liable for something[/i[, although perhaps 18 years of child support seems a bit extreme.

I didn't think there was any solution that was supposed to 100% guarantee against pregnancy (bar a hysterectomy or abstinance). The doctor's real mistake was not getting them to sign a disclaimer acknowledging that.

who knows.. I'm glad the doctor has to take sme sort of repsonsibility.. I just never thought that it would be life long responsibilty surreal
