Sperm Donor Ordered to Pay Child Support

In the early 1990s a Swedish man donated his sperm to a lesbian couple, now he is being ordered by Supreme Court to pay child support for the three resulting children.


Although the man signed a document confirming he was the biological father of the children, he told the court the women agreed he would not be involved in their upbringing in any way.

But when the women separated, the biological mother of the three boys demanded child support payments from the man.



The trial passed through regular court, before the man took the appeal up with the Supreme court, where the ruling was upheld.

It definetly sucks for the guy, but I cannot see him having any legal recourse if the agreement of his non-involvement was not recorded in some sort of contract.

Was this donation through a sperm bank, or was it informally given to the lesbian couple? If it wasn't through a sperm bank, it sucks for the guy, but that's why you do things within the system. If it was through a sperm bank, I would expect to see sperm banks dry up pretty quickly if every donor, instead of getting paid $50, has to be strapped with child support payments for the next 20 years.

I can imagine that he is peed off, but he is the father and is it most fair for him to support his child or for the state supports his child?

I can imagine that the mother may have fallen on hard times and then taken whatever action she could to support the child, even if that meant a betrayal of the fathers kindness.

It is predictable that she might do that, and he should have thought things through more carefully.

I think that it is a totally shitty action of the mother, but the legal judgement is fair; provided that it does not apply to anonymous sperm donations.

If anything, the other woman should be making child support payments, not that guy. That's just an extra shitty thing to do. It's kind of like getting a research grant to build something, hurting yourself with it, then suing whoever gave you the money to build it in the first place. At least we can look forward to some funny ads on television...

where's the other mother? did she just split and leave her ex-partner with the three kids? does she not have partial custody, or at least a sense of responsibilty for the children? pretty shitty, any way you look at it.

Well, rather than either him OR the state pay to raise the child, how about the women who agreed to raise the child in the first place fucking raise the child goddamnit? When a man and a woman get married and have a kid there's an unspoken agreement that even if they split up, they will be responsible for the child. If gay couples want the same rights then they have to accept the same fucking responsibilities. She should be able to sue the other woman who she split up with for child support, not the guy whose biological material they used.

Sadly the article makes no mention of the other womans situation. Can she be found and does she have an income to fight over?

He may have the ability to sue the other woman, if she was party to the original contract (which she seems to be). He may even be able to sue the mother if her circumstances change in the future (in the unlikely case that she becomes rich) if there is a valid contract that she would not take money from him.

However, that does not change the fact that someone needs to support the children, which he fathered.

The onus is on him to consider fully the consequences of his actions and more fool him for neglecting to do so.

The guy should and probably is going to take the case to the European Court of Justice since Sweden is a member of the EU he has the right to do so. He may or may not loose the case there too but at very least it will hold everything up for a few years and since the eldest child is 16 (i assume the children came in quick succession) by the time the case was resolved then most of the kids probably will be ineligible for maintenance payments.
