Finally got our check from the flood insurance company - $530. Sent a message to the flood cleanup people that I'd like to set up a payment plan because I can't afford to give them the $4500. Here's how it's going so far:

Them:


Normally our payment plans start out as 50% up front then a monthly agreement. With that said I can do 50%, $2168.50 received by Feb. 1st then $722.83 the first of every month thereafter.



Me:


I can't do that kind of money up front, and most certainly not $700/month. I got $500 from the insurance today, which I was planning on sending you, but we're going to have to work something better out.



Them:


Morning,
How much are you thinking you can do per month? I understand the position you are in but this balance must be paid in a timely manner.
It will look good on your account if we could receive some sort of payment soon.



Me:


I can do $250/month, with extra when I can afford it.



Them:


Justin,
With all due respect, that will take over 17 months to pay this debt off. Can we compromise with $1000 by Feb 1st then $417 per month for the next 8 months?



Me:


With all do respect, I'm not taking food off my family's table to pay this off. Let me see what I can do.



I'm half expecting this to get ugly. I've been communicative with them throughout the whole process of dealing with the insurance company. I'm willing to pay them as much as I can afford. But if they refuse to deal with me, I'll tell her to take me to court. I'll send them money every month, make copies of the checks I send and get the letters sent with a signature required. If they decide to be assholes about it, the courts will side with me as I'm making an attempt to pay the debt. Technically, I can send them a dollar a month and it is intent to pay in NJ. I'd love to pay them off quickly, but I can't afford it. Let's see where this goes. frown

My deductible was $5,000. I was lead to believe that the insurance would cover the cleanup regardless of the deductible.

the insurance really only covered that little? That's ridiculous. What about homeowner's insurance - did it cover any belongings lost (that you could shuffle to cover the cleanup)?

Was this due to a dam break, or just river flooding? I ask because if a damaged property was involved, the owner might be liable for damages (be it town, state, or private - whoever owned the dam).

Thankfully debtor's prisons haven't been resurrected... yet.

Good luck with em. I'm thinking the dollar a month plan might be easiest at this time... to keep a "negative item" off of your credit report.

Or, just fuck em. Pay what you can afford to pay each month and let them whine about it. I'm certain you're not the only one in this situation with em.

Oh god that sucks, sorry... and $5,000 Deductible? Did they tell you that when you got the insurance. I mean, Holy shit, why have insurance? Most claims are small anyways, a few hundred to a few thousand. Well, I hope they take the payment plan...
