i'm not a lawyer, but i am pretty good at digging around for shit online.

a USPTO search shows that the name John Lennon is registered for ties and sunglasses and shit, but there's no mention at all of his music.

on the other hand both Lennon and Lennon Murphy (though the second one has been abandoned) are registered for "musical sound recordings and musical video recordings".

i have no idea what that means in terms of the lawsuit though. perhaps one of the lawyers around here has an opinion?

In all fairness, and seriousness, I just checked out Lennon's Myspace page. The music is indeed quite distinguishable from John Lennon's. Thus, it certainly will be tougher for Yoko to demonstrate any "actual confusion" in trying to cancel the TM and subsequently prevent Lennon from filing any Notice of Incontestability.

And I didn't know that someone allegedly ran this by Yoko when the TM was being registered. Ideally that is when Yoko should have challenged the registration based on secondary meaning. Instead, Yoko is challenging Lennon's ability to file a Notice of Incontestability which swithces the burden of proof.

Still, I still stand by my assertion: the secondary meaning of the Lennon name is just too damn strong.

I really can't stand Yoko, at all.

Seriously, says in the article that she gave approval for the name usage back in 2000... um... prior art then?... it's been eight freaking years... seriously, what the hell?

Now, there's the other thing, what if Lennon, just went under her real name (ala Matthew Good/Matthew Good Band), wouldn't that cover it ?

I just found out that Yoko will be in a group show with me in two weeks.

Start a petition on here. Get signatures (or equivalent) from members. Hang it on her stupid tree.

I brought this fiasco to my band's attention and we are hashing out a song about this to be titled "The Warbling Lamprey." It won't likely do Lennon any good, as no one really comes to see us.biggrin But at least we can send some postive energy' her way, which is something the supposed "Peace & Love" touting Yoko used to talk about.

I only hope Darke won't sue us for our song title.tongue
