Announcement came Wednesday in favor of actress Cameron Diaz, 33, in her civil suit against photographer John Rutter, 42. Both parties had sued each other over what Rutter claimed was a misunderstanding concerning the photos and video of the actress semi-naked in bondage scenarios taken when she was nineteen. Rutter was already serving three years and eight months in prison beginning September 2005 for forgery, attempted grand larceny, and perjury from his criminal conviction in July 2005.
Brad Cafarelli, spokesman for the actress would not specify the damages awarded, although it is on record that Diaz will receive statutory damages and is also seeking an order from the court to include her legal fees, estimated at $650,000.
"Ms. Diaz obtained a summary judgement against Mr. Rutter for unauthorised commercial use of her name and likeness as well as statutory damages and there is now a permanent injunction in place prohibiting the sale, licence or other use of the materials including both the photographs and the videotape in question," Cafarelli said.
The photos had been taken prior to Diazs fame in Hollywood and Rutter attempted in vain in 2003 to convince the actress to pay him $3.5 million in order to not publish the photos. Diazs legal team accused Rutter of forging her signature on the 1992 release form and the materials were seized in a raid of his home.
Unfortunately for Diaz, the photos have made their home on the internet. And we all know that once something is set loose there, good luck reeling it back completely.
