Yeah, I actually already have a copy of the State law regading landlord-provided heat. In New Jersey, From October 1 through May 1, the temperature in the apartment may be no less than 68 degrees from 6:00am to 11:00 pm and no less than 65 degrees between 11:00 pm and 6:00 am.

The outside temperature has no bearing.

Between May 2nd and September 30th is covered under local health codes.

Seriously, just send her a copy of that law with a note that says your heat was at 58 degrees this morning and that you don't want to take it to the courts, but that it is unacceptable.

I had a similiar situation, and that cleared it right up.

Well, the thing is...I used to have control of my own thermostat. The landlord mistakenly thought I was leaving MY heat on too high and making HER apartment too hot. That's when I tried, unsuccessfullym to explain to her that heat rises and for MY upstairs apartment to hear HER donwstairs apartment it would have to be on fucking fire.

She bypassed my thermostat and now controls both units through her downstairs apartment.

So really...I don't give a flying fuck what temperature it is in her apartment. I don't care if she's sweating bullets or catching hypothermia. It's not my problem. She's the one who took control of my thermostat based on her complete ignorance of the laws of physics. She's the landlord and the one legally responsible for maintaining a suitable living environment for her tenant. She's the one who set the terms of the lease and she's also the one who signed that lease. So really...I don't care if state law mandates that I get a handjob and a puppy...if you dictated the terms of the lease...and agreed to provide heat instead of making me pay for it...shut your mouth and maintain at least the legal standard.

I think that's a good approach. Draft her a short little memorandum detailing the conditions in your place, and how they are in direct conflict with state regulations. Do not threaten; be polite; be professional. It is likely that she will play ball, as most landlords are well aware that state and local health departments GENERALLY take these matters seriously.

that's fucked up. the house that my boy's band and i live in had no heat for about 3 weeks. towards the end we had to wear coats and gloves in the living room and you could see your breath. blackeyed

Uhhh yeah you can sue her for that, if it is not specifically noted in your lease that she has the right to control temperature without your consent the what she did goes against the contract which is there to protect you, not her. Also there is the fact that you have a state rule that specifically deals with temperature indoors during the evening and the day hours. yeah, fucked is what I would say she is.

I had this exact problem when I lived in Detroit.

The heat rising thing doesnt really apply because the old vents cut off the air going upstairs to let the air in downstairs, what your fuckface landlord needs to do is close some of the fucking vents so the hot air goes up to you.

They wont want to though since its cheaper to keep your ass in a coat.

My old landlord would say that all the time and it was impossible to convince the fucker that even if his place was hot as balls the heat didnt go up to my place it leeks out windows or doors or where ever.

Also the old vents are metal so alot of the heat disapates before it gets all the way upstairs.
