Looks like the people fighting the good fight against the government's "War on Porn" have a powerful new ally. Hollywood studios are objecting to the language and scope of Section 2257 of US Code: Title 18.

The provision added to the Children's Safety Act of 2005 would require any film, TV show or digital image that contains a sex scene to come under the same government filing requirements that adult films must meet.

The provision, written by Rep. Mike Pence, R-Ind., could have ramifications beyond simply requiring someone to ensure that the names and ages of actors who partake in pretend lovemaking as compliance with Section 2257 in effect defines a movie or TV show as a pornographic work under federal law. Industry sources say the provision was included in the bill at the behest of the Justice Department. Calls to Pence's office and the Justice Department went unreturned Tuesday.

Industry officials contend that the way the provision is written, a sex scene could trigger the provision even if the actors were clothed. While the language is designed to capture "lascivious exhibition of the genitals," other legal decisions have said that "lascivious exhibition" could occur when the genitals are covered.



Industry representatives worry about the chilling effect this could have on many films, with directors deciding to cut potentially artistically important scenes rather than going through the hassle of registering a 2257 and being classified as pornographic.

With all the money and power the entertainment industry has, they might be able to weaken this law. If Hollywood studios teamed up with the Free Speech Coalition and the Electronic Frontier Foundation, they'd present a pretty formidible front against these laws.

Whatever happened to the days when people could just turn away if they didn't like what they saw? I'm not a fan of scat porn, so I don't visit scat websites. Why is this such an issue? If you don't like it don't look at it. Protect your children? Don't give them a credit card and they won't see it (granted the amount of free porn out there is, well... awesome!)
