A 17-year-old girl, in trouble for drug-related offenses, has been sentenced to probation, living with her parents, attending school... and celibacy.

No sex. That's part of a sentence imposed on a 17-year-old girl by Texas state district judge Lauri Blake.

She's ordered the young drug offender not have sex as long as she is living with her parents and attending school, as a condition of her probation.

It is one of several unorthodox rulings Judge Lauri Blake has imposed since she was elected 10 months ago in the district court that covers Fannin and Grayson counties.

She has also prohibited tattoos, body piercings, earrings and clothing "associated with the drug culture" for those on probation.



One would think that this ruling could be overturned fairly easily. I'd say sentencing a teenager to celibacy for smoking a little pot falls under "cruel and unusual punishment," wouldn't you?

I'm willing to bet that the people of Fannin and Grayson counties don't even bat an eye lash at this. They'll get uptight after someone from The Big City gets their dick in a twist. Grayson's website is top-notch.

I could understand the urge to keep kids that are already in trouble out of more potential trouble... but that doesn't give this judge the right to impose her morality on the people that come before her.

If this girl were 18, I would think the ruling would be overturned per Lawrence v. Texas. That said, I'm not so sure that the state couldn't make out a sufficiently constitutionally acceptable argument based on the fact that she's a minor. It'd be completely a bullshit argument of course, but stranger things have happened.

Uh, Texas... they do things differently down there. Funny, these "unorthodox" rulings I've always considered a good way to get people to fall in. Oh, I've just got probation, that's not so bad, or, Oh, it's just community service/fine, it's not so bad. Really fuck with them so they lose something they really care about.

However, saying you can fuck or not is not a punishment a court should hand out. Sex is part of life and as such should be done. In a healthy home, knowledge of sex should be encoraged even if the act is not during those teen years. But that is a family decision, not a judge's.

I'm waiting for a Texas judge to pass a sentence telling someone to not be gay. For the two year probation you may only have sexual relations with women, sir. If they can reguate teen sex, they'll try to regulate any sexuality.

Ya know how they have an anabuse drug for alcoholics. They'll give her some pills to take so that when a guy is doing her all she can picture is this guy.

Considering the judge I highly doubt that. Besides unless she's given the shot, who's to say that she would actually take the pills. And she's only 17 and even though the age of consent is 17 in Texas, she's still a minor. She's not allotted the same rights as everyone else above 18.

She can't sign a contract, yes. And she can't vote. But this sentance is completely uninforcable. And if it were inforced, by some strange method I can't and don't wish to imagine, that would almost certainly be an unconstitutional police action. Yes, even in Texas.

I'm pretty sure there's no law on the books preventing kids under 18 from having sex with each other. Plus, the sentence is completely irrelevent to the charge. They'd have a really tough time getting any higher court to back them on this...

Punishment must be unusual or it won't deter the criminal. If someone knows exactly what they'll get for any given crime they're able to weigh it in their mind and decide that the risk of X is worth the reward of Y. If they have no idea what kind of punishment they may get, they are left with an unknown and will recieve a shock either way that will teach them a lesson.

Apparently so! Luckily Robert Heinlein has fuckall to do with the American legal system.

Or at least, so I assume. I never made it all the way through any of his books, so I guess I'll never know for sure...

Why would it be uninforcable. If she's caught doing it, she has violated probation and goes back to jail. Not really hard at all. And I highly doubt there is anything that could be done to overturn this. Probation prohibitions are not limited in the same ways laws are. Technically, getting probation is a priviledge, not a right, and they can put some wacked out conditions on it if they want. One guy (in Florida if I recall correctly) was prohibited from drawing (even for his own entertainment) during his probation.
