His sentence should be to ride in the brakeman's seat on real trains and make him experience what rail workers see almost every day in their careers. Unfortunately, the idiots who dash across rail crossings often live to do it again and again.

of course, that statement is based on VERY limited knowlege of the legalities behind stuff like this.
You can be charged with murder if the results of your actions are negligent and would reasonably be expected to result in someones death.
I could swing an axe on a crowded train, not meaning to kill anyone (just for exercise), but if i chop off someone's head, I'm going to be charged with murder.
But would it be FIRST-degree murder? I think there might be a few degrees there. It doesn't sound like so much willful intent as not being quite aware that car vs. train doesn't mean a clear-cut victory for the train...
