Brief summary: I was hit by a drunk driver while on the back of a motorcycle. He ran, but was caught the same night. His insurance company happens to be Farmer's, and they're offering the driver and me next to nothing, even though we were both injured. I feel like I'm being fucked over twice. If anyone works for this company and can talk some sense into them, I'll give him/her free lap dances for life. Court is expensive and traumatic. Thanks.

Seriously, I hope you are allright.Insurance companies are pretty much a big racket, you pay and pay, but when the time comes that you actually need them, they dont really do shit for you.As much as it will suck, you should sue that fucker for all(whatever) he's worth.

Unless you sue, they will probably only offer you $500-$1000, plus medical bills. They are going to try to low-ball you, so you should be prepared to tell them how much you want and why. Take into consideration how much money you lost from missing work, they will pay you for that, too.

Really. Trust me on this. I was rear-ended on my motorcycle at a red light by a doctor in her BMW last summer (totally her fault and she said so to me, and the cop, and the insurance company). I wasn't injured, thankfully.

Her insurance company fought me for months on a simple damage claim, refusing to pay the full amount. I ended up getting all of it less $200 but it took several months of weekly phone calls.

If you think court is expensive, wait till you see the unreimbursed medical bills if either of you are uninsured. A nasty letter from a lawyer will get 10X more action than a claimant representing themselves. After hiring the lawyer, don't talk to the insurance company yourself, let your lawyer do it - he'll have the insurance company put everything in writing. The insurance company's adjuster will likely knock 25% right off your claim, so have your independent estimator keep that in mind when he writes up the report on the bike for you to submit. Don't forget to include damaged accessories like helmets/motorcycle jackets ($$$) on the bike estimate where applicable.

Remember, insurance companies are in business to not pay you money, or to pay you as little as possible. You sound like you have a legitimate claim, so go after them like a pit bull and don't let go until you're satisfied. The squeaky wheel really does get the grease. Be very persistent., like a phone call every week to the claim agent.

Good advice Stiles, I agree you should get a lawyer right away. You should be able to get a good lawyer that will only get paid a percentage from any extra money you get. My wife and I were rea-rended and we couldn't get in touch with anyone. About 3 weeks after the accident we went to a lawyer, the next day the people were in touch with us. All of our bills got paid and we each got $1000 or $750 extra, the lawyer took about 25% from the extra that we got.

Also keep copies of any medical bills and get proof of any missed work and any other expenses due to the accident.


Also, hope your okay from it. And it just so happens I got an advertisement flier on my door yesterday from Farmers. I'll try and have a talk with them about the lap dance... I mean... uh... the uh... yeah.

When you get a lawyer, get one through a referral from the Bar Association, or if you know a lawyer, through his or her recommendation. Do NOT hire those assholes who advertise everywhere. They suck, and they will settle for a smaller amount to make sure they get paid.

Hire the lawyer on an hourly basis, not on contingency. As open-and-shut as this case is, you're getting something out of it, and you can pay the lawyer from the money you get, which will be far less than you'd pay one of those "No fee unless you settle" assholes out of your judgment.

Agreed, Jake. I should have specified in my post not to get one of the lawyers who advertise everywhere. My lawyer works hourly, which is a lot cheaper when all you need are a couple of nasty letters and a few followup phone calls.

I would check out the the website for the American Motocycle Association, ABATE, and other such organizations.....these are reputable organizations and they can give you some good leads on contacting a lawyer in your area who specializes in motorcycle injuries and accidents....and who is also a rider him/herself....if I were ever in that position I'd want to have a lawyer who rides...because if there is one thing all motorcyclists can agree on ....is that we ALL hate cars.

But yeah, you HAVE to get a lawyer.

I do have a lawyer - a good one. She says Farmer's is THE WORST, but she has figured out ways to get them to pay her clients more. However, my case was weakened by us having had a not-so-great lawyer initially, who steered the case in the wrong direction, and me not having received enough medical treatment. (I'm on Medi-Cal for low-income Californians, and they only cover so much - most docs don't want to deal with a state-funded insurance.) Then I got assaulted by a pervert and was back on crutches - same ER, same doc. My lawyer says they'll try to worm their way out by blaming everything on Pervert, eggshell defense or no. She also claims court is way too expensive and traumatic to make it worth it at this point. Also, no blood from a stone. If the drunk doesn't have it, it doesn't matter how much I win.

My dad is a house lawyer for Farmer's. So, there's little to no chance that he is going to want to do the opposite of what his job is.

I have a quick joke for you. I think only British people will get this one though.

I'm certainly not asking anyone to put his or her job on the line for me. I'm just wondering if there's a Farmer's insider who can advocate for me within the Farmer's network. (I can dream, and cats have been born with wings - albeit not many cats, but it has happened.) I am in the right, and while I'm lucky I'm not paralyzed, considering the impact made by my body against his car, it hurts. It hurts my body and it hurts my heart to know that the driver left me for dead and basically got off with a love pat. And when I say Farmer's is the worst, I mean from my perspective. Of course, the drunk would say they're the best, and who am I to decide that the victim's best interest is more important than the perpetrator's? After all, the ego has its own agenda. Well, my ego says that my id deserves compensation before a drunk, cowardly frat boy needs his tracks covered, that's all.
