Agreed. The way I understand it, is even if the fetus wasn't viable outside the womb at the time of death(which this one obviously was) a person can still be charged with it's murder though. The law looks at the intent of the mother to keep the baby. In other words, even if a woman had only been 4 months pregnant, but had demonstrated intent on bringing the child into the world(like being excited about it, buying some nursery supplies, etc., etc.) then the murderer could still be charged with it's death. This is how I've seen it explained on the news anyway, and this is what seperates charging somebody with a fetus' muder from chargeing an abortion clinic Doc


Let's hope you are right. Let's hope that the public is willing to allow our legal system to continue to tell the difference. Let's hope this issue doesn't succumb to the slippery slope.
