I agree with a few of you though, who have said Yes, he's a scumbag.......but being a scumbag doesn't equal a trial by jury.

So, while we don't know the facts of THIS case, I still have to disagree on the issue of the victim's "judgement" being a defense.


Well, I think this example is beyond bad judgement. It's a complete lapse in common sense akin to characters in bad horror movies. That, in and off itself, sows a seed of doubt to me. Coupled with the fact that this man is worth a lot of money



How do you KNOW that this example is beyond bad judgement? It could be very possible that she wanted to hang out with a famous guy, and went to his hotel room with the intention of hooking up with him but not having sex. While that might not be the best idea ever.....how is that "beyond bad judgement"?



From what little I've heard, it will be a hard sell to convince me he raped her.

See, for me it's easy to believe he did it, considering all the trouble he's been in before and the way he presents himself on TV. But we shouldn't be letting either of our opinions on that subject color whether he goes to jail or not.

Again, I don't see how bad judgement makes it less hard to believe someone was raped. Maybe she was dumb. Maybe she trusted him. Maybe she thought that he was sketchy but that he would never actually hurt her. Maybe she thought it was okay to have drinks with someone. None of those things make her any less likely to have been raped. It's hard to see where our judgement will lead us, if she was raped I'm sure she never thought that her actions would end in her being violated.

Because this man has, as is documented on video and aired on cable television, consistently tried to illicit sexual activity from every woman he has come across. Further that with his reputation and you can assume what he is thinking quite easily when he is alone with a girl.

When did I say I made my mind up? I said from what I'd heard it would be a hard sell to prove his guilt and that is what a trial is, a proof of guilt. Until then, the accused is assumed innocent. What my statement was was that I am not jumping to a conclusion, I think you read into what I said aa a conclusion as opposed to me stating one.

I couldn't agree with you more. I'd love to see him rot in a cell. I watched a documentary on him on VH1 and it made me want to vomit.

I think you missed my point. What I am saying is that all of these things, along with other tidbits in the story (such as her not having a blood sample and the fact that he is rich and an easy target) add to the possibility that this could be a bullshit charge. It sounds like, from what you're saying, that you're arguing whether or not her bad judgement would make unconsentual sex not rape which is not what I'm talking about at all.

I'm not so sure about that. I haven't seen many documentaries on Stern where there are girls going on crying about how he made them do things they didn't want to do on his radio show. Not the case with Joe Francis. There was a fair amount of that.
Although your public persona argument does add fodder to mine that more needs to be looked into with this case. From what his been seen, yes, he seems like a complete douche. Maybe the media slants him to be worse than he is. All that said, it would make him an easy target to be accused of rape.

The main point I was trying to make here before this became an all out battle of semantics was that there is still a lot to be investigated before we string this man up or profess his innocence and sainthood.

It's all relative. I sounded more like I was on his side because it seemed like a lot of people had him hauled off to prison in their minds, so I suppose I came in a little heavier on his end of the scale. I don't like the guy from what I've seen of him and I wouldn't be surprised if he did it, I just don't think enough is in to make a decision yet by a longshot.

i think that's a stupid argument. maybe her intentions were to go back to this guy's room and have sex with him. but if she was drugged she then loses the ability to consent and then it becomes rape.

it shouldn't matter what her intentions were or if we think it was bad judgement or not. if she was raped she didn't deserve it just because of her choices.
