+1 - if she isn't old enough to make an informed decision about sex, she isn't old enough to make an informed decision about piercing her genitalia either. Can't have it both ways.

There's a little more horrifying information here. A commenter at Lawyers, Guns and Money suggests that this might have been a case where the prosecution overreached.

The prosecution, or the judge? From what I've read, the mother was willing to plead guilty to child abuse, and the judge didn't allow the deal. Sounds like the judge was determined it was aggravated child abuse, not regular child abuse. Due to that stance, the mother got off, because the jurors couldn't bring themselves to convict on aggravated child abuse.
Lame. I feel so bad for that kid.
Wow. Stories like this make me think I'd be an excellent mom, at least in comparison. I mean, I could REALLY screw up a kid, and still look better than chicks like this.
