SYLVANIA, Alabama - It turns out that you can be charged with a DUI...even when you're not in a car. A drugged-out cowgirl found that out the hard way.
A woman used a horse to ram a police car during a midnight ride through town and was charged with driving under the influence, police said. DUI charges can apply even if the vehicle has four legs instead of wheels, Chief Brad Gregg said Tuesday.
After police received a call that a woman was riding a horse in the middle of the street, an officer confronted Melissa Byrum York, 40, and asked her to stop.
"She wouldn't stop," he said. "She kept riding the horse and going on."
After ramming the police car with the horse and riding away, York tried to jump off but caught her foot in a stirrup, Gregg said.
Miss York was arrested and charged with a list of crimes, including:
DUI on suspicion of riding the horse under the influence of a controlled substance
Drug possession (crystal meth and marijuana)
Possession of drug paraphernalia (pipe)
Resisting arrest
Assault
Attempting to elude police
Cruelty to animals
York was released from the DeKalb County jail on $4,000 bond, then, to add insult to injury, was transferred to a different jail for an unrelated charge.

i know..drugs are bad! ha but this is still somewhat amusing. sorry. (and yes, i grew up in Alabama..but there weren't alot of horses in my 'hood)

Seriously though, a competent lawyer could get the DUI and cruelty charges tossed, but that's small fish compared to the other charges. They're going to hurt.
The cops can charge you with literally anything. Then they have to prove it in court, plus if the charges are too obviously bogus they open themselves up to countersuits and possibly judicial reprimands.
I think that riding a horse while drunk shouldn't really be considered a crime. Unlike a car, horses won't do really stupid things when you tell them to.

My friend was having a bonfire one night, up on the hill behind his house. His neighbor got drunk, and started to cut the grass on his riding mower. (This was around midnight, if not later.)
They told me he drove on their property, and kept going near the fire, just missing it 2 or 3 times.
I just played that song in front of about 200 drunk sveeedish tourists tnight.

As a proud multiple DWI offender I commend her on her brave and commendable attempt at outrunning the police who most likely would have shot her dead like Sean Bell if they could actually aim. I've yet to outrun the cops on a horse but she gets my thumbs up on that one! I only wish her the best and hope the police crash and burn in another scandal.
