Hey guys, we're pulling all the videos off the site and won't be adding anymore. We are put on notice by a company called Acacia, who claim to own a patent for all video on the web.

You can learn more here if you are so inclined:

http://www.rwonline.com/reference-room/special-report/01_rwm_patentclaim-03.12.03.shtml

We just don't have the dough to fight it, and video isn't our thing anyway. So feel free to download all the videos while you can, it will take us a few weeks to get them down. Also since we're not going to put these videos up on the site, feel free to share them via your favorite p2p client (not the pics, just the vids)! Let's see how they work as p2p commercials for the site.

Does anyone have the videos already downloaded? I'm getting empty links for some of them and for the sake of completeness would really love to have copies of all of them.

For what it's worth, that fucking patent is NEVER gonna be upheld. It reminds me of the guy who filed a claim on all the land on the Moon and sent a letter to the U.S. and Russian governments informing them of what he had done. When he was asked about it, he said something like "well, they never contacted me, so I guess that means I own the Moon."

This reminds me of what Unisys did in 1994: because it owned the patent on the compression algorithm used in GIF images, it was able to claim licensing fees on all software used to develop or produce GIFs.

However, the tack being taken by Acacia strikes me as a far less tenable position than Unisys', because instead of targeting software developers using their patented compression algorithm, they're targeting content providers who are ex post facto users of the technology.

Nonetheless, I've always maintained that software and algorithm patents are going to be the death of the tech industry, and sadly, it looks like I'm being proven right.

Add this to the Eolas complaint regarding plugin use (the use of quicktime on this site also falls on this) and you are about to see the most "interactive" elements of the web be dismantled since providers will refuse services (like pulling video's off their sites) and patent-holders demanding licensing fees in return for patent-use.

More and more, intellectual property laws are no longer appropriate in their current form for internet-based applications. It's a shining example of the legislative branch's, whose bills are footed via the big-business pocketbooks (particularly in the US - or "western" world), inability to keep up with technology and software development.

The internet will go nowhere (well, depending on what you consider to be somewhere) if these issues prevail.

Or George Selden, the patent lawyer who "patented" the horseless carriage in 1879 (but it wasn't issued until 1895 due to Selden's savvy procrastination). Until the patent was declared null & void in 1911 (due to Henry Ford), all US automakers had to pay Selden a licensing fee to build their cars.

A more detailed explanation can be found here.

Oh, it will go somewhere: underground. Historically, when laws or acts are made that are 1) widely unpopular and 2) difficult to enforce, you see a huge increase of illegal underground activity until the government catches on and rescinds its decision. That's what happened during the Prohibition Era with "speakeasies", and that's what's happening with P2P file sharing services now.

I'm not so sure. In the case of prohibition you have a product that was widely available and desired by the regular public (or drinking establishment) whereas the internet, and specifically for broadband uses like streaming media, or flash plugins, is still a commodity. Even in countries like the US, it's still a lot easier to get booze than highspeed connections that are neccessary for streaming media. If, and I'm sure this will go underground, it's successful, I will be surprised to say the least, but even still, it's still a long way off. How many internet savvy people do you know who are willing to wait around for the proper legislation?

This is a big nuisance.

Jesus...

Just when you think the system can't get anymore backasswards... some stupid shit like this comes along and fucking blows my mind.

That's like saying someone owns the patent on the wheel and systematically charging every car manufacturer fines for using them.

This is bullshit like Avril Lavigne!

I'm saddened by this announcement. I really liked the videos. I think that lawsuit has a snowball's chance in hell of standing, but that's less important to me than Sean saying "it's not really their thing." I thought it added some character to the site, and thought it fit pretty well. After all, how many porn sites have vids of their girls talking about their favorite bands or hobbies? But I guess that's not the way it's gonna be. Well, at least I think I have the full set. I'll share it up for posterity's sake.

I too think eventually the patent will be overturned. We'll do videos again when that happens, but sadly, until then, we just can't afford the licensing fees or fight such a large company.

It's capitalism, and the patent bureau is filled with morons, so they're trying to make some money. In a suck ass way, and I think in the end they'll fail, but I don't begrudge them trying.
