Well, what an interesting discussion. For my part I think the classification of rape as a weapon of war is a big step forward, as it will allow the UN to get involved, where previously it would have been classified as criminal activity, and beyond their mandate (I think).

But back to the new topic of the thread:

What concerns me is how do you deal with a situation like the Congo, where although the "war" is dying down, the rape has increased.



A few surgeons from my hospital just recently came back and did a presentation on this rape phenomenon, where rape, a tool that had been used by the various warring parties fighting for control by spreading fear, has become so commonplace that it occurs even more than it was at the height of the war. It happens in the UN refugee camps, and it happens in the villages the villagers. The phenomenon was caused by the war, and the UN is present in the Congo, but what can they really do about this? Couldn't they still escape justice from the UN by claiming it is not a war crime, because it was not an act of a warring party?

I think this statement was made to deal with exactly that kind of situation. You see, by classifying rape as a weapon of war the UN is recognising that although the shooting may have died down a little, the war is still raging but through the use of a different weapon, which is being directed specifically against the civilian population (which makes it a war crime).

So now they can, in principle, do something about it...

If soldiers who are allowed to shoot terrorists rather than "observe" were stationed in Lebanon, Hezbollah wouldn't be gearing up for another war.

I won't even mention El Baradei and his toothless, blind IAEA. as Israel is going to have to sort out Iran's Philadelphia experiment on their own. I believe current labor and immigration laws should be changed to put more pressure on dishonest management who hire illegal immigrants for the purpose of exploiting their illegal status for personal gain (low pay, zero benefits, zero rights). I think immigrants who are clearly making a productive living in this country should be allowed to stay. I also think people who don't bother working should be shipped to some island where they can have their lack of productivity only affect themselves, but that's just me.

Well see that's where I'm concerned. Because the rape isn't being done by the soldiers or the tribes anymore. It has become commonplace.
Lemme try and stretch this to an analogy. Theft has always been commonplace during war. Pillaging is a time-honored war tool used by occupying forces to further control a local population. But if the UN made this a war-crime, could they then take standard cat burglars to a tribunal?
ok so that was a crappy analogy, but hopefully you got my point. Violent gang rape was brought by war to the Congo, but it has quickly taken on as a sick trend there. A large population of men in the area questioned were not even sure as to the definition of rape. It is no longer war. It is life. I don't envy the defense attorneys here, but they'd have a lot to go on.
And even when it is done by soldiers, it is often perpetrated by guerilla soldiers, in very remote regions. It takes the survivors days to get to a hospital, let alone tell authorities who would in turn track them down.

Many of the rights people fight/fought for require changing the current system. You must agree with this concept, since our country's system has changed so many times to make room for everyone's freedoms. Of course, I'm not too judgmental towards people who break current laws in order to lead a life of hard work that improves this country. I don't think slaves who broke the law and escaped to the North did anything unethical because I disagree with the idea of slavery and zero worker's rights. I don't think immigrants who steal SS#'s in order to work are doing anything unethical because they are paying into a system from which they get nothing back.

I believe current labor and immigration laws should be changed to put more pressure on dishonest management who hire illegal immigrants for the purpose of exploiting their illegal status for personal gain (low pay, zero benefits, zero rights). I think immigrants who are clearly making a productive living in this country should be allowed to stay. I also think people who don't bother working should be shipped to some island where they can have their lack of productivity only affect themselves, but that's just me.
