I'd like to clarify my previous statement and specify oyaji as getting the fuck you. If anyone cares to explain this 'retarded' attitude towards Iowa and the midwest in general then I'd have no problem getting into it in a more appropriate place.

That said, the ruling by the judge has been stayed, but not before 1 couple did get married.

This is a better argument. But rational basis review is just a way, really, of imposing judicial personal preference over legislative preference. It's not going to go the way you want it to go if it is reviewed by any one of a wide, wide swath of the judges on the federal bench.



It can be. But it also can have some teeth to it, even in situations similar to this. See: Romer. Now, I'm not arguing this will hold up on appeal, but I don't see the harm in the continual push towards equality through both political and judicial channels.

One moment, on the logic. If they're allowed only civil contracts, not marriage, then they couldn't go to a church that will "marry them."

And that's the point. There will always be a distiction. Equality would be the right to have the same thing, without the distinction.



Marriage is a religous ceremony, a judge can marry people and that would technically be considered a civil contract if you think about it.

Sorry, but no it's not. My wife and I were married by a judge. Marriage is not necessarily a religious ceremony.



Ok, I think your missing my point, and I am afraid your also thinking that I think gays should not have equal rights so let me clear up that I think they should, I think it's stupid that they can't get married.

That being the case however you need to break past the ignorance of people who are somehow afraid that gay marriage will somehow affect THEIR churchs and that they will have to see a never ending stream og gays getting married or some other wacked out BS. The only way that I can see to break this is to allow civil ceremonies so that they can in fact get the legal recognition they deserve. even if it's only one step it's a step in the right direction, and since there are churches that will perform the marriage ceremonies they can in fact have everything they deserve, yeah it will take time for alot of people to catch up and accept it but like I said one step at a time. Right now the whole debate is being purposely focused towards gay marriage as a whole because both sides know that there is no way it's going to happen like that, it's a wedge issue that both sides have acknowledged has a working solution to and that most americans would support, but Damn if neither side wants to lose out on that issue and lose votes.
