The Constitution says precisely nothing about how the head of the Executive Branch must execute the laws. It says more about how he is to be elected than it says about the "how" of his power. Executive Orders are formal statements of policy, by the President, of how he will run his own branch of government. And when limited to his own branch, absolutely constitutional. Only if such an order usurps the authority of one of the other branches, would it be unconstitutional.
And any other branch telling him he can't use them would likewise be unconstitutional.

i can addmit when i am mistaken. i worked this out at work it was all i could think about. and i came to the understanding you described above. thanx for not taking anything personal.
There's more... in the patriot act, under this scenario, a couple other nasty things will happen. All private property instantaneously becomes gov't property, and many private militia groups, many of which are KKK-ish in nature, will be deputized as U.S. Marshals, to "keep the peace." U.S. Marshals have the power to go up to your local city hall, and tell everybody what to do, including the mayor and the police, as well as any public utilities or transportation. And with as many troops as we have overseas, this scenario is quite likely if any "emergency" were to happen, whether inflicted by terrorists or "terrorists." Scary, huh?
You guys should also look up the "Coalition for a New American Century" document. You can read it right on the U.S. Gov't's own website, under the Freedom of Information Act. It's dry and boring, but if you actually read it, get ready to be horrified.

if this article had been researched better and written in a more objective fashion, would it still be relevant enough to warrant discussion? if we are going to rush to snap judgments based on information we haven't required the author to back up with actual facts, then does it matter if we're under a dictatorship or not? we'll believe anything we're told so in a way we've already given up our rights (who needs free thought?).
