Yes, I believe O'Reilly's head must have imploded. If you look at the footage closely, it's physically impossible for something that huge to collapse on it's own without explosives having been planted. I'm going to have to agree with Rosie O'Donnell on this one.

While O'Reilly is one of the most loathed people in the world, to me, and Geraldo is right on many points, and O'Reilly can't make up a good argument for his case ever and always relies on the straw man fallacy, that being said, I do think its retarded that immigration status isn't double checked and enforced when a crime warrants such consideration. To clarify my subjective opinion of when that is, it would be anytime the crime committed has a direct impact on another. I've had two friends' lives turned upside down, one thrown into abject poverty in fact, because they were creamed by an illegal driver from whom they were completely unable to receive restitution from.
recap: not supporting O'reilly, but being illegal is, unarguably, illegal.

Thanks for the clarification but, isn't this the point of the whole debate? This guy should have been deported and he wasn't. I guess now I understand why some people wish to eliminate the term "illegal alien" and replace it with "undocumented alien" since, if there is no penalty, why call it illegal in the first place? Constitutional, criminal, or administrative...laws exist to govern. If there is no penalty, or no tangible penalty, why have the law to begin with?

It's not that there's no (or effectively no) penalty for being in the country illegally. It's that the only penalty for it is to be sent back where you came from. If it were any other way, and it was a crime, with criminal penalties (what Oyaji was getting at) the "illegal" would be entitled to their day in court, facing the evidence against them, with appeals, etc., etc. You couldn't simply ship'em back where they came from.

Since it's covered under a different section of law, only a government agent who enforces that kind of law is trained and eligible to do so. That goes for all of the other varieties of law as well. As an illustration, since it's tax season here in the U.S.: If you fail to file your federal income tax, you have violated the law. But a traffic cop has no jurisdiction to check whether you've filed properly if he pulls you over for speeding. The same is true of immigration law. He isn't qualified, nor has he any jurisdiction, to check anyone's immigration status.

The fundamental flaw to O'Reilly's stance is that it assumes the cop would have some reasonable cause to think the guy was a foreign national (whether here on a passport, one of several kinds of visa, or "undocumented") of whom it would be reasonable to request documentation. Can you say, "racial profiling?"

Otherwise, the cops would just have to ask everyone they pulled over for proof of residency status. I don't know about you, but even though I have a passport, I don't typically carry it with me. No other form of ID that I ever carry would constitute such proof. Do you want the police to start asking everyone "PAPERS PLEASE?"
